Section 1 Scope

 

These General Terms and Conditions apply to the conclusion of agreements of the modules for the EFA European Fashion Academy UG.

Section 2 Term, Termination, Cancellation, Form of Instruction

 

The European Fashion Academy Diploma consists of 8 individual modules, which are designed in detail and in a construction-based way. The program contents and their goals can be found on our website. Each module has a defined a duration of approx. 2 months and ends automatically with the expiry of time. The start of the course is the date indicated on the website. The date of the first module may be postponed by one month, i.e. start 07.04.2020 instead of 06.04.2020. The following modules will then be automatically moved by one month, as they are based on each other. The participants will be informed by the European Fashion Academy about the start of the first module at least 2 weeks before the start of the booked individual course in writing – by email – about the final start. The course agreement for a single booked module is non-cancellable and also non-refundable during the term. This also applies to the conclusion of a contract of 8 modules= one year of training. The European Fashion Academy will provide a participant's credit to take any course. The credit note does not expire.

 

The right to extraordinary termination remains unaffected (Section 626 of the German Civil Code). Such extraordinary termination must be made in writing within two weeks of the knowledge or occurrence of the important reason. If, for reasons beyond its control, in particular in cases of force majeure, it is impossible for the European Fashion Academy to provide the service in accordance with the contract for a period of up to three months, this does not give the participant the right to terminate the contract, but he is not entitled to payment of remuneration by the participant for the period of impossibility. The other legal rights of the participant remain unaffected. The European Fashion Academy reserves the right to postpone the individual course to the next start date due to insufficient number of participants. The participant will be informed in writing of the postponement no later than 2 weeks before the start of the booked individual course. The participant is then automatically registered for the corresponding next module. A claim for damages by the participant in the event of such a postponement is excluded.

 

If the participant has previously made rebookings on the relevant individual course or module, the right of withdrawal is excluded. If the participant does not exercise his right of withdrawal, participation in the follow-up courses already booked will be postponed accordingly. The training takes place exclusively in the virtual classroom "Virtual classroom" means an online teaching in real time. The provision of the technical entry requirements for participation in the form of teaching "virtual classroom" and "WBT" (in particular) Internet and accessable medium to the Internet) is the responsibility of the participant and should in any case be checked for functional activity before the beginning of the lesson. The Virtual Classroom is open about 15min before the start of the lesson, so that all participants can dial in easily and the lessons can start on time. The European Fashion Academy does not pay for any delays or dial-in problems of the participants and the course fees will not be refunded. Each participant is responsible for being in the virtual classroom on time. Delays of more than 15 minutes will not be accepted and participants will be eliminated from the Virtual Classroom for each day.

Section 3 Fees, payment methods, delay

 

The fees to be paid ("module fees") must be paid by the participant in advance, irrespective of the use of the services. The amount of the fees is based on the agreement that the participant concludes with the European Fashion Academy. These can be booked and paid directly via the shop on the website: www.europeanfashionacademy.com. Each module has a basic price, which is explained with more information on our website. Payment deadlines are the decisive factor for compliance with payment deadlines. This amount must be received no later than two weeks before the start of the course. If the payment deadline is not met, the Academy is entitled to sub-tell the student the right to participate in the course.

Section 4 Fees for enrollments or changes to the contract

 

The European Fashion Academy does not charge enrollment fees or contract change fees. The course or module fees are final prices.

There are no price differentiations between European and non-European participants.

 

 

Section 5 Examination Application

 

The registration for a training course also includes the registration for the examination taking place there, after each module. ( One-year training with diploma ). This is connected at no cost. However, if the level is not sufficient for the participation of a second module, which follows, the participant is obliged to take tutoring courses in order to reach the expected level. These tutoring courses come at an additional cost and are tailored to the student. The cost does not exceed 20€/hour.

Section 6 Examination Results

 

If the participant intends to contest the results of the examination, he/she must do so within 7 days of the publication of the grades. The challenge must be substantiated in writing. After the expiry of the time limit, the result of the examination is no longer open to challenge. After the exam, the student agrees to make them available to the Academy for advertising purposes.

The possible postal fees will be paid by the Academy. Insofar as examination services are provided by deception or legal violations, in particular infringements of copyright or intellectual property of third parties (in particular by plagiarizing or imitating services or works of third parties), an examination result may be revoked at any time, even retrospectively.

Section 7 Non-participation in examinations

 

If a student does not take an unexcused examination, he/she will incur additional costs of €150. If a student is unable to take an examination due to medically certified illness, a check-up must be carried out immediately after the end of the illness. The fee for a practical collective inspection is € 50,-. This must be transferred by the student at least one week before the examination date.

 

 

Section 8 Confirmation of participation, placement test

 

After completion of each individual course or module (regardless of the result of the examination), the student receives a confirmation of participation and an assessment of his or her work. With the confirmation of participation, the student is entitled to attend the following individual course. The student can skip a single course if he has any knowledge (classification test) and take the following individual course directly. A placement test is possible no later than four weeks before the respective course start. Registration must be made in writing; the fee of € 100,- € must be paid no later than 1 week before the trial date. The participant is only deemed to be binding upon payment of the fee. If the participant had already booked a single course skipped by a successfully passed placement test, this booking applies to the individual course booked immediately following by the participant. All other booked follow-up courses do not shift in time.

Section 9 Confirmation of participation, placement test

Section 10 Transfer of rights by participants, obligations

 

Upon conclusion of this Agreement, the Participant shall give the European Fashion Academy consent to the non-exclusive, unlimited use of material produced in the classroom or in examinations by the Participant in which the Participant has a copyright or other intellectual property right. This consent applies only to the use for free reproduction, exhibition and publication purposes in the classroom, at information events or online appearances. If material created by the participant in the classroom contains copyrighted or other protected content, the use by the participant is only permitted after approval and within the scope of the specifications of the European Fashion Academy. However, the use for own applications or similar purposes is permitted in principle. Furthermore, the participant is not authorized to make course materials (sound, film, image or print materials) available to third parties. The participant is aware that participating in the course may require the use of software that requires personal registration.

 

 

Section 11 Liability of the European Fashion Academy

 

A liability of the European Fashion Academy, regardless of the legal reason, is excluded.

 

 

Section 12 Data Protection

The European Fashion Academy also collects, uses and stores personal data of the participant in order to process the individual course and training agreements. The European Fashion Academy treats this data strictly confidentially and exclusively in compliance with the applicable data protection regulations. This data will only be used for market research and/or advertising purposes of the European Fashion Academy if this is within the legally permissible scope or if the participant has expressly consented to this use.

Section 13 Other provisions

 

Should individual provisions of these General Terms and Conditions be ineffective, the validity of the remaining provisions shall not be affected. German law applies. Oral side agreements were not made. Changes or additions always be made in writing.
